General Conditions of Sale (GCS) for purchases made online on the site www.idealmoda.it
APD Moda S.r.l., Via Nazionale 80, 80143 Naples, fax: +39 081 260870 ("Ideal Moda") invites users to read these General Conditions of Sale ("CGV") Which regulate the purchase of products and the management of orders placed on the site.
On the website www.idealmoda.it both "Ideal Moda Products" and "Ideal Moda Partner Products" are offered for sale. "
Ideal Moda product / s”Means all products offered on www.idealmoda.it, with the exception of those specified as Products of Ideal Moda Partners.
“Ideal Moda Partner Products”Indicates the products offered onwww.idealmoda.it specifically referred to as a Partner's products.
1. Conclusion of the contract and delivery of the products
1.1 Any order placed onwww.idealmoda.it implies the conclusion of a sales contract in Italian. When the order relates to an Ideal Moda Product, a single contract is concluded between the buyer and APD Moda S.r.l., Via Nazionale 80, 80143 Naples ("Ideal Moda"). When the order relates to an Ideal Moda Partner Product, a further contract is concluded with the respective Ideal Moda Partner. The quality of Ideal Moda Partner is specifically indicated on the detail page of each individual product.
1.2 By clicking on the "Buy now”The customer places a binding order for the items contained in the virtual shopping cart. Once the order has been sent, Ideal Moda will send the customer an e-mail confirming the order within 1 hour. The sales contract is concluded between Ideal Moda and the customer when the latter receives the order confirmation. If the customer does not receive any order confirmation within the deadline indicated in this art. 1.2., The relative order must be considered rejected by Ideal Moda and, therefore, without effect.
Orders in relation to which the customer has opted for advance payment will be shipped as soon as Ideal Moda receives the total payment of the purchase price and any shipping costs. Ideal Moda therefore invites the customer to pay the price as soon as the order confirmation is received and in any case within the following 7 days.
1.3 Where the products covered by the order are not available for reasons independent of Ideal Moda's conduct, the latter must promptly notify the customer. In this case, there will be no obligation for Ideal Moda to deliver the ordered goods, unless Ideal Moda has assumed the supply risk in relation to the products that make up the order in question.
In any case, if the ordered products are not available, Ideal Moda will refund, in favor of the customer, any sum already paid.
1.4Ideal Moda assumes no responsibility for having to search and find unavailable products from other sources. This provision also applies to orders relating to fungible goods (for which only the type and characteristics of the products are described). Ideal Moda is only obliged to deliver what is available in stock and what has been ordered to its suppliers. The Ideal Moda warehouse also includes the warehouses of the respective Ideal Moda Partners from which the products ordered by the customer come from. Ideal Moda makes deliveries in Italy only. If the delivery time is expressed in working days, it is understood as such all those included between Monday and Friday included, with the express exclusion of any holidays.
1.5 If you buy with Scalapay you will receive your order immediately and pay in 3 installments. You acknowledge that the installments will be transferred to Incremento SPV S.r.l., to related parties and their assignees, and that you authorize this transfer.
2.Prices, shipping costs and express delivery
2.1 The customer is required to pay the price published on the product page at the time the order is sent. The indicated price is final and inclusive of VAT.
2.2 Ideal Moda uses express forwarding services exclusively, provided by the transport companies GLS and DHL. The delivery times for both services will vary between 24 and 48 hours from order fulfillment. Orders placed in the late afternoon of Friday and throughout the weekend will be processed the following Monday, for management not dependent on Ideal Moda.
2.3 Shipping costs throughout Italy with GLS express courier are € 5.95 for orders with a total value between € 0.01 and € 69.99, and free for orders over € 70. Variable costs will be applied for foreign shipments based on the country of destination, as indicated on the product detail page and in the cart when placing the order. These shipping costs are invoiced by Ideal Moda. In the event that the Customer returns the products in accordance with the procedure provided for by these conditions and by the applicable legislation, the shipping costs will be reimbursed.
2.4 DHL express delivery is available for the entire product range. At the time of placing the order, the customer will see the possibility of opting for this express shipment with the related additional cost of € 9, a surcharge justified by a higher quality during transport, guaranteed by the service provider. The option categorically provides for the delivery of the goods within a maximum of 2 working days. If the delivery does not take place within this period, the customer will be reimbursed for the shipping costs, if incurred.
3. Payment
3.1 Ideal Moda accepts various payment methods including, for indicative purposes: by credit card, Paypal, Amazon Pay, iDeal, Bancontact and cash on delivery with a surcharge (€ 5.95). Ideal Moda reserves the right to refuse certain payment methods and to request different payment methods for certain orders. Note that Ideal Moda only accepts payments from bank accounts within the European Union (EU) and that the customer is responsible for all costs associated with the transaction.
3.2 In the case of a purchase made with a credit card, the charge is made at the time of shipment of the order.
3.3 The buyer agrees to receive invoices and credits exclusively in electronic format.
4.Use of promotional vouchers
4.1 Promotional vouchers cannot be purchased, they are offered by Ideal Moda as part of promotional campaigns and can be used for a limited period of validity.
4.2 Promotional vouchers can be used only once in relation to a single order, within the specified validity period. It is possible that for the purchase of some products the possibility of using promotional vouchers is excluded. Promotional vouchers cannot be used for the purchase of gift vouchers. It is possible that the use of a promotional voucher is subject to a minimum amount of expenditure.
4.3 The value of the products purchased must be equal to or greater than the value of the promotional voucher. If the amount of the promotional voucher is not sufficient to cover the value of the products ordered, the difference can be paid through any of the accepted payment methods referred to in Article 3 above. Promotional vouchers are not redeemable in cash and do not accrue interest on the credit represented by them. Promotional vouchers will not be refunded if the buyer decides to partially or completely return the ordered products.
4.4 Promotional vouchers can only be used if the order is finalized, they cannot be used retroactively and cannot be transferred to third parties. Unless otherwise provided by Ideal Moda, it is not possible to combine several promotional vouchers for the same order.
4.5 If during the order the customer used a promotional voucher and if the total value of the order - due to the customer's withdrawal - should be lower than the value of the promotional voucher, Ideal Moda reserves the right from now on to invoice the original price of the goods that remain in the possession of the customer.
5.Use of gift vouchers
5.1 Gift vouchers can be purchased, and can only be used for the purchase of Ideal Moda Products or Ideal Moda Partners, but not for the purchase of additional gift vouchers. If the value of the gift vouchers is not sufficient to cover the value of the products ordered, the difference can be paid through any of the accepted payment methods.
5.2 Gift cards can only be used before placing the order, they are not refundable in cash and interest does not accrue on the credit represented by them. The buyer who wants to redeem a gift voucher, transfer its credit to the account and check the balance, please visit the "My account" section on the site www.idealmoda.it.
6. Right of withdrawal
The customer has the right to withdraw from any order concerning Ideal Moda Products, without giving any reasons and with any declaration, as long as explicit, delivered to Ideal Moda.
If the customer intends to return the purchased products, he can contact Ideal Moda support at support@idealmoda.it.
6.1 Information regarding the right of withdrawal (pursuant to Article 49, paragraph 1, letter (h) of Legislative Decree no. 206/2005 "Consumer Code")
The customer has the right to withdraw from the contract, without giving any reason, within 14 days. The withdrawal period expires after 14 days from the day on which the customer or a third party, other than the carrier and designated by the customer, acquires physical possession of the last good ordered. In the event of a contract relating to multiple goods ordered by the customer in a single order and delivered separately, the 14-day term starts from the day on which the customer or a third party, other than the carrier designated by the latter, acquires physical possession of the last good.
To exercise the right of withdrawal, it is necessary to inform Ideal Moda (APD Moda S.r.l., Via Nazionale 80, 80143 Napoli, fax: +39 081 260870 e-mail: support@idealmoda.it) of the decision to withdraw from this contract through any explicit declaration to this effect (for example, by a letter sent by post, fax or e-mail).
6.2 Effects of withdrawal
Following the withdrawal from this contract, Ideal Moda will reimburse all payments made by the buyer, including delivery costs for shipment to Italy (with the exception of any additional costs deriving from the choice of a type of delivery other than the standard one offered by Ideal. Moda in the national territory), without undue delay and in any case no later than 14 days from the day on which Ideal Moda is informed by the customer of the decision to exercise the right of withdrawal. For shipments made in international territory, the costs will be borne by the customer and only the costs of the product will be reimbursed. These refunds will be made using the same payment instrument used by the customer during the purchase, unless otherwise agreed. In any case, the customer will not have to incur any costs as a consequence of this reimbursement. The refund may be suspended until Ideal Moda receives the returned products or until the customer demonstrates that such goods have been shipped, if earlier.
The customer is required to return or deliver the products without undue delay and in any case within 14 days from the day on which he communicated his intention to withdraw from the sales contract.
The return methods are as follows:
- The customer sends the garment by any courier to the Ideal Moda headquarters located in Via Nazionale, 80 - Naples - 80143
- Ideal Moda takes care of the collection at a cost of € 9 via GLS courier
Although the conditions mentioned below are not penalizing for the purpose of exercising the right of withdrawal, the products must be returned:
- properly packaged in their original packaging, not damaged, damaged or soiled and equipped with any accessories, instructions for use and documentation;
- with the transport document (present in the original packaging), in order to allow Ideal Moda to identify the customer (order number, name, surname and address);
- without obvious signs of use, other than those compatible with carrying out a normal test of the article (they must not bear traces of prolonged use or in any case exceeding the time necessary for a test and must not be in such a state as not to allow resale).
If the returned product does not comply with the provisions of the previous paragraph, the seller reserves the right, as part of the refund, to withhold a sum equal to the depreciation of the value of the asset.
The customer is therefore only responsible for the decrease in the value of the asset due to manipulation other than that necessary for the evaluation of its nature, characteristics and correct use of the same.
For national and non-national shipments the return costs are charged to the customer. The customer is responsible for any decrease in the value of the goods resulting from the handling of the goods other than that necessary to establish the nature, characteristics and functioning of the products themselves.
7. Refunds
Invoices will be issued exclusively in electronic format.
7.1 Refunds are credited directly to the account or payment instrument used at the time of purchase upon receipt of the return. For payments made by bank transfer, the refund will be made to the account used for the payment. For payments made via Paypal, Amazon Pay or credit card, the refund will be made to the Paypal account, Amazon Pay account or credit card. For payments made by cash on delivery, the refund will be made, alternatively, to the current account that the customer will indicate to Ideal Moda or by crediting the customer's account. If a gift voucher was used for the order, Ideal Moda will re-credit the relative amount to the customer's account.

9. Warranty for defects and non-conformities of the products and additional information
9.1 Purchases made on Ideal Moda are subject to the rules of the Consumer Code regarding the guarantee for product defects and discrepancies. The customer will therefore be granted the rights referred to in art. 130 of the Consumer Code and these rights must be exercised under the terms of art. 132 of the same Consumer Code.
9.2 These GCS can be consulted on the sitewww.idealmoda.it and can be saved using the relative browser command (usually, File -> Save As).
9.3 It is possible to archive the details of the order and download the GCS using the relative browser command to save the order summary that appears in the last screen of the purchase process, or waiting to receive the automatic order confirmation message that Zalando sends via email following the completion of the order. This confirmation message includes the order details and the Zalando GCS, and can easily be printed or saved using the functions made available by the e-mail programs.
10. Applicable law
10.1 These GCS and sales contracts are governed by Italian law (and in particular by the Consumer Code - which in articles 46 to 67 governs distance contracts - and by Legislative Decree 70 of 09/04/2003 on the subject of e-commerce) and in the light of this they must be interpreted.
10.2 For any dispute that may arise in connection with the GCS and / or sales contracts, customers will be able to activate an out-of-court dispute resolution procedure in compliance with the requirements set out in art. 141 and ss. of the Consumer Code.
10.3 The Customer also has the right to use the online dispute resolution procedure available on http://ec.europa.eu/consumers/odr/
